whether you arrive legally or not, overstay your visa or not, or regardless if you violate any other immigration law. Jurisdiction is not dependent on compliance.
If people here aren't under US jurisdiction -- or the states therein -- then they could commit crimes with impunity and face nothing more severe than deportation.
Are you really suggesting that there is no jurisdiction?
