crime and let the jury decide?

eg. 1st degree murder, 2nd degree murder & 3rd degree murder?

Or can the jury still convict him of a lesser crime if they don't think the prosecutors can prove the higher crime beyond a reasonable doubt?

It seems to me that trying to convict him/them of *intentionally* killing him is going to be a very high bar to clear.
