They could say that the drugs and underlying health issues helped contribute to the guy's death and that the cop had no actual intent of killing the man. The state of mind is the most important part and it is going to be very hard to prove that the cop intentionally decided to kill the guy when you have this autopsy report staring the jury in the fact.
