You have a right to your life, liberty, and property without any sort of mandate from anyone. That does not mean that those rights can be infringed upon, but they remain your rights nonetheless.
Within your framework, I would suggest you use a different word than "right". Why are you insistent on call it the "right" to education? When at the same time you concede it is not a "right" and that it only exists by force?
