i'd imagine even in private courts or in private law/private road scenarios, you'd develop ways to revoke privileges.
That's an inherent issue with "public" roads. If roads were funded privately and managed privately, it's a property rights issue and the property owner could revoke driving privileges.
instead, we put people in jail, punish them, incarcerate them all in the name of protecting and serving "the public good".
