Libertarians...should there be a penalty for DUI?

should there be a legal penalty without property damage or personal injury or should cops let them drive impaired unless they actually hit someone or something?
A local woman was just sentenced to 51 years to life for killing 3 teens in a DUI accident .....she had a blood alcohol level of .30, nearly four times the legal limit for driving..... she also had a previous conviction for DUI.
Had cops seen her before the accident, should they have been able to stop her from driving? Or would that be an infringement since no-one had been harmed yet?
