the juvenile offender, not the privacy of their victim.

That's why it's based on the age of the offender, not the age of the victim. For example, in states with confidentiality, a juvenile molests a 40-year-old and the record would be sealed, but a 40-year-old molests a 6-year-old and the record is public.
