Important to remember the history: Fox and ESPN acted in extraordinary good faith in keeping payment with the Big 12 level even as the league contracted by 2 teams. That happened fairly quickly and perhaps contracts were not as air tight as one would expect. It would appear that ESPN and Fox expected the conference to act in equal good faith in pursuing new members that add value.
