The courts have ruled that the NCAA constitutes a "trust" (illegal collusion) between the universities to control wages/compensation.

That's true regardless of whether Duke is a member or not.

And if the NCAA tries to enforce its pay caps, Duke's players can file antitrust lawsuits against the NCAA – and would win.
