First, I'd point out that this morning's conversation was about whether there is a right to abort a fetus. There is no such right. But, that's different from the questions asked here. Rights don't coincide very well with modern day positivist criminal codes.
As for your questions on timing and culpability of individuals involved, I don't think I could adequately supply answers to those questions without engaging in positivist rulemaking proposals that I try to avoid in all instances (See my comments about cultural problems with "armchair jailing of people"). If anything, it would likely be case-by-case and would take into consideration the timing and motivations of the unique act and those specifically involved.
As you know, I'm not a supporter of positivist lawmaking.
I'm a supporter of a natural law between humans. So, your questions are really hard to answer for that reason. I try to directly answer questions, but this is the best I can do here. They are tough questions.
With all of the foregoing noted, I am personally very much against abortion and I find cavalier attitudes toward the act to be incredibly off-putting. I'm not on board with any mass movements that marginalize human life (in any manifestation).
