Was he resisting as they took him from his car to the sidewalk. Did he appear agitated..yes..resisting..not at all. He then sat there quietly until they moved him over to the car and tried to put him in there (which goes against your story above that they were not planning on taking him to the precinct to book him.

And not to mention being on his throat for WAAYY to long for a guy that was claiming trouble breathing.
