the crime is conspiring with foreign agents for purposes of influencing a US election (if that's a crime even).

I agree that the obtaining or publishing wouldn't be a crime. It would just be an overt act in furtherance of a different crime. (Again, it would have to be determined that is a crime capable of being charged.)
