I am, I believe a conspiracy requires an "overt act" in furtherance of the crime. I'm not sure that the "overt act" in and of itself has to be criminal. It can be an act that, in the abstract, is perfectly normal and legal, but when added to the facts, becomes a necessary check in the boxes needed to charge conspiracy.
I'm not saying that's the case, just that I think I've heard that before, so it suggests a possibility.
