but again, the question is whether an act, innocent by itself, can be part of the crime of conspiracy if, taken together with other acts, constitutes a crime.

And I agree that publishing hacked e-mails wouldn't be. But would seeking to obtain illegally hacked e-mails from a foreign agent for the purposes of influencing a federal election? I don't think they're looking to charge anyone with publishing hacked e-mails.
