The idea of creating a child outside of the legal partnership (marriage) which existed at the time the embryos were created doesn't wash with me.

Nothing would prevent her from getting the embryos created and then ditching him the very next day if that's allowed.

There's an expectation here about the "use" of that or "development" of that joint property.
