or whether 1182 is itself constitutional. the question is whether the eo is constitutional. it is not.

"their job was not to rule on the content of the eo" can you explain what you mean by this? the court is not imposing its judgment on whether the order is good or bad policy.

the notion that the order is not subject to judicial review is the one without precedent. i don't think you're suggesting that here, though many have.
