I do not think Trump should take this fight to a 4-4 SC.

Liberal judges have shown time and time again that agenda trumps law and precedence. A split SC judgement means that the 9th court ruling stands and becomes the law of the land. That is very dangerous for the security of the nation and not a gamble he should take.

What he should do is rescind the current EO making this ruling meaningless. There has been no court case yet just a stay on his immigration ban. Rescinding the current EO effectively kills the current case.

He should then reissue a new EO that addresses the issues of green card holders and visas already issued. That will clean up most of the things the court directly addressed.

Then the most important thing, he needs to kick the GOP leaders in the azz and tell them to fast track his people, most importantly Gorsuch, so that when the next court challenge, and there will be endless challenges, happens he will have his people in place to fight it and not have to rely on Obama holdovers who were likely not giving their best effort.

My fear is that his ego will tell him to fight this to a supreme court that is not currently ready to hear the case. A loss there would be devastating.
