why do we call the transfer rules a "penalty"?

If a kid wants to transfer and the accepting school wants to accept her, she can transfer and immediately go on full athletic scholarship plus "full cost of attendance", room and board and books.

She simply must wait a year before she is eligible to compete in competition.

In the meantime she can practice with the team, train with the team, eat at the training table, receive medical care, receive tutoring and "total person" type programming.

The NCAA only restricts activities where it has member-mandated oversight: determining who is eligible for competition.
