but in the case of the US the government was set up by the constitution which was ratified by elected representatives of each state thus giving it legal status which makes it legitimate (lawful).

I can see your point though - something that is legitimate is within the law or follows the law, so when no law existed, how can gov't be legitimate?

So let's not say it is legitimate - let's just say it is ACCEPTED by the people as a way to produce order thru rule of law.
