Yes, it's fallacious because it is an assertion being called fact which is 100% impossible to disprove or prove.

Yours is the epitome of the self-sealing fallacy.

If I stated it as fact that I am God you can't disprove it, but I can say "There is a God" "I am manifesting myself to Bob" and "Bob can go tell someone I am God" and it would be every bit as logically binding as what your are presenting.

I.e. 100% not logically binding.

It's a fallacy.
