get that it's just one side of the story. I also get that most grand juries return indictments.

But my point is, without the photo, I doubt there is enough evidence for an indictment. Which is why I am guessing the prosecutor has access to the photo.

I have seen statistics for federal grand juries and they almost always return indictment. Have not see statistics at the state level, though.
