My original point was about the constitution not being infallible. Originally most blacks (happy now) were only counted as 3/5ths (again happy) that of a white man. That was constitutional at the time. Not now. The constitution has changed because times have changed and previous rulings have been determined to be incorrect.

Slavery is no longer allowed. Jim Crow laws are no longer allowed. The constitution or rulings on it were found to be wrong.

The commerce clause does not cover someone not involved in that commerce. And the SC never ruled that it did. The SC ruled that ACA was a constitutional TAX.
