Yes, the SC with future verifications challenging established case law and working it's way back up through the system again.
Thus, the rights not written directly in the Constitution are expanded and established through subsequent interpretation of the Constitution. And if it weren't for this process, women wouldn't vote, Wal Mart would be segregation, handicapped kids wouldn't be allowed in mainstream classes, and people could yell fire in a crowded theatre.
