Obviously that's what the 9th Circuit is hanging its hat on. It seems to me though if you are going to decide likelihood of success on the merits, a federal statute that appears to grant the President the exclusive authority to take the action he took would be mentioned. Are they saying then the federal statute is Unconstitutional?
We shall see. Congrats on being 5th in your Con law class. I don't know where I finished in Con law, probably lower than 5th, but I did graduate 8th in my class overall. Of course that was a while ago and I deal with more mundane issues like contracts.
