The Judge provided no legal citations to support his finding of likelihood of success on the merits or the threat of irreparable harm, two of the necessary elements the PLAINTIFFS must prove. Nor did he explain how the states even have standing in any detail (other than a vague reference). Nor did he provide any citation to any evidence presented by the plaintiffs. While TRO's are granted generally without an evidentiary hearing, the plaintiffs must provide some evidence to meet their burden in the form of affidavits, etc. Perhaps they did, but its not referenced in the order.
I've seen better written TRO orders by state court judges in non-compete cases. And they don't generally have law clerks to research and write orders for them.
This is one of the thinnest supported orders I've ever seen issued by a federal district judge.
