and this ignores the construction issues re: the establishment clause claim, is that the seven identified countries have a predominant religion. and the order specifically prefers the minority refugees of those nations. and trump campaigned on this issue and has, since the order was issued, clarified it was to give preference to christian refugees over muslim refugees.
and so it violates the establishment clause. and the court is authorized to entertain the actual motive of the party who entered the order and is not restrained to the four corners of the document.
