unlawful entry vs unlawful presence
Entering without inspection is committing the crime of unlawful entry and is most certainly a crime. Continued presence after committing the crime of unlawful entry is an additional civil offense but is sort of irrelevant b/c the crime was when the individual entered.
if you enter legally but overstay your Visa that is a civil offense, although obviously still deportable. that's an unlawful presence.
