but judges are as political as the politicians, and inconsistent as well, which is why the fight for judges is intense, when it should not be, and they first talk about who appointed the judge.
They have two choices.
Follow the law as written, or follow the Constitution. In most cases they do neither, rather they do how they wish.
That was the point of my OP.
In my opinion, even though I am against government control of abortion, the Supreme Court was correct in striking down Roe v Wade, and that it is a State issue.
But then they tell the State of New York that they can not have any gun control laws, when there are two things. The State of New York is not subject to the Federal Constitution, and the Constitution does have an equivalent 2nd amendment. It should be the New York State Supreme Court that should decide on those cases.
