It wasn't until 1898 in the Kim Ark case and a 6-2 ruling that leveraged the 14th in this manner.

You'll note that there was a dissenting opinion and there were elements of Kim Ark's status and that of his parents that many of these "birthright citizens" don't meet.

We'll see this issue reconsidered.
