It seems to me, however, that when applied to the situation of a car surrounded by an angry mob kicking, banging on windows & jumping on a vehicle that one *should* be justified in trying to drive out of there, slowly if possible, but more forcefully if they keep crowding around the front of the vehicle (if you are trying to drive forward).
Shouldn't that be "assumption of the risk" on the part of those crowding in front of the vehicle and the occupants who are being threatened?
Waiting for windows to be smashed, with glass flying or for members of the mob reaching in trying to drag people out may be too late to protect oneself or others. That seems to be the threshold that the attorney felt was needed based upon similar criteria as stated in the Missouri statutes.
