but unless they subjugate themselves to those systems, or unless the law grants those systems (e.g., mandatory arbitration, which by the way is also subject to government laws and regulations) then in this country, they have no power.
And rights are constantly in competition. Almost every case that ends up before the Supreme Court involves competing rights. Go ahead. Pick any case and I'll show you.
