The NCAA likely wasn't counting on KU being this successful while floating this investigation over their heads. There was likely an expectation that KU would slip into middle of the big 12 while eeking into the NCAA tourn an 8 to 10 seed then drop the hammer. KU serves with no spotlight, boom over with.

Not to mention, KU being on the same recruiting trails as the UK's the Duke's the UNC's etc etc god knows what the FBI/NCAA dug up on other blue bloods while digging into KU. Pretty sure KU legal representation knows this too.
