better known as a Terry Stop or a Terry Stop and Frisk from 1968 US Supreme Court ruling in Terry v Ohio. And it goes on 1,000's of times of day in every jurisdiction from coast to coast. it is not a unique NYC thing.
predicated on reasonable suspicion; which is supported by articulable facts that a particular person is about to commit a crime, is committing a crime, or just committed a crime AND that they are armed and dangerous an officer may briefly stop and frisk the individual.
now, i realize that A. there are certain posters here who will disagree with that ruling and that's fine. I'm not here to argue the validity of the ruling. i'm only pointing out that it IS the current law. And B. I realize that Terry Stops can be abused. There is no blanket authority to stop anyone just as there is no blanket authority to frisk everyone you stop.
Any gun, drugs or other contraband recovered that was NOT in accordance with the legal basis for a Terry stop would be inadmissible under most circumstances.
