The schools choose to sell the jerseys- they aren't compelled to. Kind of like a school chooses to employ students to work at a cafeteria, they are forced to comply with state minimum wage requirements.
I'm not sure where you are going with the non-profit status deal. It's a tax designation. That's it. Has no bearing whatsoever on the California law. 501(c)(3)'s still have to comply with a number of state and federal laws. Literally only a tax status.
You know very little about the law and it's application in these United States.
