Look, you can debate the merits of the interstate commerce argument all you want, but in the end it will be a sufficient reason (or pretext) for the conservative Supreme Court to rule in favor of the NCAA, which they will WANT to do.
Requiring non-profit organizations to pay their VOLUNTEERS is a radical left-wing idea, not a conservative one. It's why the pay-for-play legislation is being proposed by radical democrats, and will only pass in liberal states like California.
Even if you assume the 501(c)(3) schools are employers and the student-athletes are employees, a free market would allow the employer and employees to mutually agree upon compensation (e.g. scholarships & other benefits). Government intervention forcing employers to pay more than employees are willing to work for isn't a free market at all.
At this point, you should just admit that you've lost the argument and move on.
