The defense does not have to explain it away as the judge refused to admit his wealth as evidence.
The prosecution has to PROVE he committed tax fraud. It should be easy:
1) Produce evidence of how much income he earned from US and foreign sources in the tax years in question.
2) Produce his tax returns for the tax years in question.
3) Reconcile the difference.
