Spending lavishly is "evidence" of a certain lifestyle. So the prosecutors build that aspect. It then becomes incumbent upon the defense to explain it away. A) He earns a lot; B) Gifted to him; C) Independently wealthy; D) Found the ostrich jacket at Goodwill; - whatever the explanation may be. I just think it's dumb of the Judge to say that spending lavishly isn't probative. It may or may not be.
