The author's point what that the more expansive view of property rights would have covered the specific religious freedom argument which was used.
What the article did not address, was the scope of the defense offered by the bakery owner. If the owner did not allege property rights as the basis for his objection, then that issue was not before the SC such that the SC could review it.
