A police office investigates what he/she believes to be a crime, or what is reported to them as something which might be a crime, and generates a report based upon that investigation. The police officer, might have a law degree, but in the exercise of their position they cannot use that degree to come to a legal conclusion without being licensed to practice law in the state. They certainly are not vested with legal authority to file charges, even in municipal court. The unlicensed practice of law would be the unauthorized practice of law, which is strictly prohibited.
The filing of charges is a formal procedure which absolutely requires the signature of a prosecutor.
