In municipal cases (like this one), the officer would file a ticket/charge for DWI the night/time of arrest if the BAC was over the legal limit. To be released PFI (pending further investigation) for a matter like this with a sufficient BAC would be very unusual. In matters where more testing is needed (my assumption here), or when state charges will be sought (unlikely here), then PFI's are more common.
Although a prosecutor does have to "sign off" on a ticket, in muni cases it is the officer that files the initial charges. The prosecutor's signature or sign-off may not occur for some time after the event and is a formality in all but rare cases. Your point is spot on in state court however.
