due to Colorado, Texas, Texas A&M, Texas Tech, Oklahoma, and Oklahoma State joining the Pac-10 to form the Pac-16... Colorado had already left at that point, and the other 5 were on the verge of leaving.
The Big12 was essentially dead, and therefore KU had no choice.
As long as the Big12 remains a viable power conference for both KU and K-State (i.e. is able to keep Texas and OU) then the KS legislature is going to prevent KU from leaving and CAUSING the Big12 to collapse (more specifically, causing K-State to become irrelevant and lose tens of millions of dollars per year).
The most likely scenario (though still very unlikely) would be the B1G inviting Oklahoma and Kansas as a package deal (i.e. only if it can get BOTH schools to keep the league at an even number). In that case, Oklahoma and Kansas would BOTH need approval from their state legislatures to effectively destroy the Big12 and cause oSu and K-State to become irrelevant and lose tens of millions of dollars per year. It's extremely unlikely that both state governments would allow such a thing to happen.
