"Unless they provide for a step-up in basis (that presently exists with the estate tax regime)" And record keeping would be a massive PITA - trying to determine the decedent's original basis.
Part of the statutes surrounding estate tax law is the provision for basis step-up at the decedents DOD (it it's part of the estate - the heir gets to value the asset at the value it would be at the time of the death - unrecognized gains are not subject to tax.
Without that step-up, if you inherit El's example below - $8k/acre land (for which he paid $1k/ac) - there's a $7k/ac gain that was not subject to tax. (i.e. without a basis step-up provision, your basis would be the $1k instead of the $8k). Paying tax on that $7k gain - when sold - would be a massive tax hit for heirs.
