says they must 1st reside in the US then congress has the right to establish the rules under which that residence takes place.

Not immigration, naturalization.

Now, if they simply want to come in and not have a chance to naturalize, then fine, but they must stay in the state that allowed them in and go thru the process set by the state for each state they wish to enter.
