The Trump staff is probably surprised that the Attorney Generals and chief counsels for blue states and the cities are using public funds to sue the federal government over whatever actions it takes. Republican AG’s had taken the lead in suing the Obama administration over many of its regulations and orders. So it should be no surprise that the dozen states still controlled by the Democrats will try to use the courts to block actions by the Trump government. Republicans did it first! So they should have expected to find the Democrats in Congress, the media, and the Democratic state attorney generals to oppose and seek to block the government from acting.
We now discover that the liberal federal justices, who are now dominant around the nation after 8 years of President Obama are also the opposition party, imputing motive as to what the President really intended to do, even if he did not specifically do it, and then ruling against him based on what they said he really meant. However, our system is set up for a neutral, non-political judiciary to be the final arbiter of the rule of law. So what does an administration do when it learns that the judiciary intends to run the country as they see fit? Do you accept rule by the judiciary or do you set about to evict a couple dozen liberal justices, which would disrupt all other actions in Washington, bring the liberal devotees into the streets in even more protests, and double the shouting by the media. Impeachment would not work anyway, since the obstruction party holds 48% of the Senate and it takes a 2/3 vote to convict an impeached officer. The progressives would succeed in disrupting all intended actions and tying up the government. Does Trump think far enough ahead to realize that all the fights will succeed in disruption any constructive actions by the federal government?
Is there any surprise then, that the Trump government might be developing a bunker mentality? Yes, the Senate is slowly approving all nominees. Yes, Congress is advancing the repeal of recent Obama administration rules. Yes, they have begun the process of defunding Obamacare and Dodd-Frank provisions that can be curtailed under budget resolutions. But outside the quiet halls of Congress, the opposition is trying to stop everything. We can probably expect legal suits against whatever Congress can pass on a simple majority, and judges setting their own law on these suits. There will be no new legislation that can be blocked by the filibuster rules. All most interesting.
