nowhere has he said it was illegal, just not a direct power granted by the Constitution.

Due to his natural rights bent, he probably feels that they are not acceptable, but all he has argued in this thread is that the Constitution does not directly grant this power. In this he is correct. The authority has been inferred by the Supreme Court
