It's not "falsifying" anything. The score is what the score is, to use your black/white style. Either it's "adjusted" per allowable NCAA guidelines or it's not. Either way, it's not a "falsified" score, it's the actual, rule-adjusted metric.
I agree with your last statement. I'm glad to see they've now included a 2 year institutional waiver - that makes sense for guys who are going the JUCO transfer route because they want playing time or avoiding sitting for a year and are otherwise academically sound. 3.3's a little high, in my books, but it's something. Agree that it doesn't measure what they think it does, nor does it discourage coaches from recruiting questionable students. It just encourages them to set up UNC academic programs.
