premeditated killing of a 1 day old child or a 75 year old man?
Same charges with the same penalty...
In California, a conviction for first degree murder can result in one of three sentences: Imprisonment in state prison for a term of 25 years to life; Life imprisonment in state prison without the possibility of parole; or Death
California state laws set the term of imprisonment for second degree murder as 15 years to life in state prison.
