So if a cop was chasing me and I shot at him and it was because I primarily wanted him to stop chasing me, I shouldn't be charged with a felony, right?
If the act that you do effects the election it is against the law.
As far as being charged, the EXACT same logic can be used for the original investigation into Clinton's emails.
Charges routinely are not invoked for simple reason of intent, and the likelihood of conviction.
Both are identical. While, yes, Comey did break the law, no one will even try to prove that he intended to do so. And Clinton was not charged for the same reason.
