Many of those polls were released before Oct 28th so they obviously aren't taking her criminal investigation into account. Even some of those released a couple of days later had all of the phone calls before or on the 28th. If I recall, even one of the ones released today had been taken before an on the 28th.
Others have been taken over a range such that many or most of the calls were before the FBI reopened it's criminal investigation of Hillary again.
