With the Supreme Court's latest ruling, it will be much more difficult for an inferior court judge, such as a District Judge to make that determination. Before this ruling, even Trump hating Judge Boesberg of the DC Circuit. was unable to establish that a class existed for the Venezuelan TDS gang members ICE deported to El Salvador. He couldn't even establish his jurisdiction and completely skipped this hurdle before he ask the plaintiffs and the DOJ for briefs to determine whether a potential class existed. Its not going to work out as you think.
